Terms of Service for Labyrinth

Welcome to Labyrinth, an AI-powered interactive storytelling and game platform operated by Matchue Studios Inc. ("we," "us," or "our"). By accessing or using Labyrinth (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users, including visitors, registered users, and subscribers. We reserve the right to update these Terms at any time. Changes will be posted here with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance.

1. Eligibility and User Accounts

  • You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.
  • To access certain features (e.g., premium content or mature themes), you must be at least 18 years old, verified through our age confirmation process (e.g., providing date of birth and payment method), and hold an active Labyrinth Pass subscription.
  • You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.
  • We may suspend or terminate accounts for violations of these Terms.

2. Subscriptions and Payments

  • Labyrinth offers tiered access. Upgrades require a Labyrinth Pass subscription.
  • Subscriptions are billed monthly or as specified during signup via third-party payment processors (e.g., Stripe). Prices are in CAD and subject to applicable taxes.
  • Subscriptions auto-renew unless canceled. You may cancel anytime, but no refunds for partial periods.
  • We may change pricing with notice. Failure to pay may result in suspension.

3. Use of the Service

  • Labyrinth allows users to generate interactive stories, images, and games using AI tools. You may input prompts, make choices, and engage in narratives.
  • You agree to use the Service only for lawful purposes and in compliance with these Terms.
  • Prohibited activities include:
    • Violating laws or third-party rights (e.g., intellectual property infringement).
    • Harassing, abusing, or harming others.
    • Attempting to hack, disrupt, or reverse-engineer the Service.
    • Generating or distributing illegal content (e.g., child exploitation, non-consensual acts, or hate speech).
    • Using automated tools to scrape or overload the Service.
  • We may monitor usage to enforce these Terms but are not obligated to do so.

4. AI-Generated Content and Outputs

  • The Service uses generative AI to create text, images, and other outputs based on user inputs. Outputs are not pre-approved or controlled by us.
  • Disclaimer of Responsibility: We do not guarantee the accuracy, appropriateness, or quality of AI-generated outputs. Outputs may contain errors, biases, or offensive material inherent to AI models. You use the Service at your own risk and are solely responsible for any consequences arising from generated content, including its use, sharing, or impact. Matchue Studios disclaims all liability for AI outputs, to the fullest extent permitted by law.
  • You retain ownership of your inputs but grant us a non-exclusive license to use them to provide and improve the Service.
  • AI outputs are licensed to you for personal, non-commercial use only. Do not use them to create harmful, deceptive, or illegal content.

5. Mature Content

  • Labyrinth may generate mature content (e.g., adult themes, violence, or sexual elements) only if:
    • You are verified as 18+ via our age confirmation process (e.g., date of birth and payment details).
    • You hold an active Labyrinth Pass subscription.
    • You explicitly opt-in through account settings.
  • Even with opt-in, mature content must comply with laws and these Terms. We prohibit illegal or non-consensual depictions.
  • We use moderation tools (e.g., AI filters) to block inappropriate requests, but we do not guarantee perfect enforcement. You are responsible for ensuring your use complies with applicable laws.
  • Access to mature content may be revoked if we suspect misuse or false verification.

6. Intellectual Property

  • The Service, including its software, designs, and AI tools, is owned by Matchue Studios or our licensors. You receive a limited, revocable license to use it as provided.
  • User-generated content (e.g., prompts) remains yours, but AI outputs may incorporate third-party elements. Do not claim ownership of AI-generated elements trained on public data.

7. Data Collection and Privacy

  • We collect personal data (e.g., name, email, age, payment info) and usage data (e.g., prompts, interactions, device info) to provide, improve, and secure the Service.
  • We track analytics for personalization, advertising, and performance (e.g., via cookies or similar technologies). This may include sharing anonymized data with partners.
  • We comply with applicable privacy laws. You may request data access or deletion via admin@matchue.ca.

8. Disclaimers and Limitation of Liability

  • The Service is provided "as is" without warranties of any kind. We do not warrant uninterrupted access, error-free outputs, or fitness for a particular purpose.
  • To the fullest extent permitted by law, Matchue Studios, its affiliates, and licensors shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the Service, including loss of data, profits, or harm from AI outputs.
  • Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
  • These limitations apply even if we have been advised of the possibility of such damages.

9. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate your access for violations, non-payment, or at our discretion.
  • Upon termination, your license ends, and we may delete your data.

10. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of Alberta, Canada, without regard to conflict of laws principles.
  • Disputes shall be resolved exclusively in the courts of Calgary, Alberta.
  • For users in other jurisdictions, mandatory local laws may apply.

11. Miscellaneous

  • If any provision is unenforceable, the rest remain in effect.
  • These Terms constitute the entire agreement between you and us.
  • We may assign these Terms without notice.
